Terms of Service

These Terms of Service ("Terms") govern your access to and use of Scubra ("the Service") at scubra.com. By creating an account or using the Service, you agree to these Terms.
1. The Service
Scubra is a software-as-a-service platform that helps dive centers register, track, service, and report on diving equipment. Features include equipment registration, QR-code labels, service-due alerts, usage logging, and compliance reporting.
2. Accounts
You must be at least 18 years old and authorized to act on behalf of your organization to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
3. Plans and Billing
Scubra offers a Free plan (limited to 10 items per organization) and a paid Shop plan. Paid subscriptions are billed monthly via Stripe through Clerk Billing. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice; existing subscribers are billed at their current rate until renewal.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law or regulation.
- Reverse-engineer, decompile, or attempt to extract source code, except where allowed by law.
- Resell or sublicense the Service to third parties without our written consent.
- Upload content that infringes intellectual-property rights or contains malicious code.
- Attempt to disrupt or impair the Service's availability or integrity.
5. Your Content
You retain all rights to the equipment data, service records, and other content you upload ("Customer Data"). You grant Scubra a limited license to host, process, and display Customer Data solely to provide the Service. We do not use Customer Data to train machine-learning models.
6. Compliance Reporting Disclaimer
Scubra provides tools to help you maintain equipment records and generate reports. Scubra is not a substitute for professional inspection, certification, or legal advice. You remain solely responsible for the safety of your equipment, the accuracy of the data you enter, and compliance with all applicable regulations and standards (including but not limited to EN 250, EN 13319, PED, and local diving authority requirements).
7. Service Availability
We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be announced in advance where practicable. We are not liable for downtime caused by third-party providers (hosting, authentication, payment processing) outside our reasonable control.
8. Termination
You may cancel your subscription at any time from the dashboard. We may suspend or terminate accounts that violate these Terms. On termination, you may export your data for up to 30 days; after that, data is deleted in accordance with our Privacy Policy.
9. Warranty Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Scubra's total liability for any claim arising out of or related to the Service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or loss of data.
11. Indemnification
You agree to indemnify and hold Scubra harmless from claims arising out of your use of the Service, your Customer Data, or your violation of these Terms.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect.
13. Governing Law
These Terms are governed by the laws of the jurisdiction where Scubra is established, without regard to conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the courts in that jurisdiction.
